Somali Teenagers Freed on Bail After Kenyan Flag Desecration Incident

A Kenyan Flag

Two Somali teenagers accused of desecrating the Kenyan flag during a football match at Nyayo Stadium have been released on a cash bail of Ksh.50,000 each.

The minors, aged 14 and 17, were arrested after a viral video showed them stepping on the national flag following a match between Mogadishu FC and Kenya Police on September 25. They face charges of being in the country illegally, damaging a national symbol, and causing public disturbance.

The court has not taken their plea yet, as the Directorate of Public Prosecutions (DPP) awaits a probation report. The two are expected to return to court on October 8 for further directions.

Desecrating the Kenyan flag is a criminal offense under the National Flag, Emblems and Names Act (Cap. 99). Offenders can face fines of up to Ksh.5,000 or imprisonment of up to six months. The law treats the flag as a vital symbol of unity and patriotism.

Official & Public Reaction

Interior Cabinet Secretary Kipchumba Murkomen condemned the act, warning that mocking national symbols undermines the country’s identity and will not be tolerated. The incident also drew sharp reactions online, with many Kenyans calling for strict punishment, while others urged for leniency since the accused are minors.

Juvenile Justice Angle

Because the suspects are under 18, the case falls under Kenya’s Children Act, which prioritizes rehabilitation over harsh sentencing. Courts often consider non-custodial measures for minors to balance accountability with child protection.

Wider Impact

The incident has sparked debates about patriotism, national respect, and the role of young people in upholding civic values. It has also drawn diplomatic attention, with Somali officials describing the act as “regrettable” and not representative of Somali culture.
